Arrests and citations in the Blue Mountain Eagle are taken from the logs of law enforcement agencies. Every effort is made to report the court disposition of arrest cases.


Grant County Circuit Court


Nicky J. Ballou, 41, John Day, pleaded guilty to being a felon in possession of a firearm committed on March 1. This was a probation violation for a 2016 sentence for being a felon in possession of a restricted weapon and a 2017 sentence for third-degree theft. A charge of unlawful possession of a firearm was dismissed. Ballou was sentenced to 50 days in jail, 36 months probation, 80 hours of community service and $350 in fines and fees.

Aaron M. Roseberry, 31, Canyon City, pleaded guilty to felony possession of methamphetamine committed on April 28. This was a probation violation for a 2017 sentence for harassment and attempt to commit a Class A misdemeanor. A charge of frequenting a place where a controlled substance is used was dismissed. Roseberry was sentenced to 20 days in jail, 18 months probation, 80 hours of community service and $525 in fines and fees. His driver’s license was suspended for six months.

Jessica L. Officer, 30, John Day, pleaded guilty to one count of recklessly endangering another person and one count of pointing a firearm at another person committed on May 2. Charges of attempting to commit a Class C felony and menacing were dismissed. She was sentenced to 30 days in jail, 24 months probation, 50 hours of community service and $200 in fines and fees.

Bryan P. Martin, 40, Prairie City, was found guilty of being in possession of intoxicants, which was in violation of probation conditions for his 2016 sentence for DUII. He was sentenced to an additional 10 hours of community service.

Jeremiah O. Gwalthney, 40, John Day, was found guilty of failure to complete treatment and failure to pay, which were conditions of his 2016 sentence for DUII and driving uninsured. His probation conditions were extended for 12 months, and he was ordered to pay $75 in fees.

May 14: Dillon Winters, 20, John Day, was cited for minor in possession of alcohol.

May 14: Fredrick Gardner, 65, John Day, was cited for refusal to give a breath test and violation of the open container law.

May 15: Richie Colbeth, 79, John Day, was cited for third-degree criminal mischief.

May 17: Following a report of a man attempting to take photos at a mobile home in John Day, Alan Wolfe, 30, was arrested and charged with criminal trespass, theft, disorderly conduct and criminal mischief.

May 18: Responded with mental health personnel to Southwest Violet Street in John Day.

May 20: Received a report of child neglect.

May 14: Advised of a bull on Highway 395 near the Ritter junction.

May 16: Advised of cows on Highway 26 at the west John Day city limits.

May 14: Dispatched to a report of suspicious circumstances at an apartment complex in east John Day.

May 14: Responded to a report of a suspicious person on Eastside Lane in John Day.

May 17: Received a report of a person with dementia on Highland Terrace in Mt. Vernon acting violently.

May 18: Advised of a dog damaging a car at a gas station in Canyon City.

May 18: Received a report of a dispute on Mountain Boulevard in Mt. Vernon.

May 18: Received a report of trespassing on North River Road in Prairie City.

May 19: Dispatched to a home on South Canyon Boulevard in John Day. John D. Colton, 37, Prairie City, was arrested and charged with a domestic crime.

May 19: Advised of a drive-off at a gas station in west John Day.

May 19: Received a report of a theft at a residence on Highway 26 west of John Day.

May 19: Responded with Bureau of Land Management personnel to Canyon Mountain Trail and warned a person not to take up residence on public lands.

May 19: Dispatched to East Riverside Street in Mt. Vernon for a report of a restraining order violation.

May 19: Responded to an assault report on East Riverside Street in Mt. Vernon.

May 20: Dispatched with Oregon State Police to East Main Street in John Day for a report of a break-in.

May 20: A child missing at a mobile home park in John Day was located unharmed.

May 20: Followed up on a telephonic harassment report on Cottonwood Street in Mt. Vernon.

May 20: Advised of a possible probation violation on South Fork Road in Dayville.

May 20: Responded to a report of offensive littering on Forest Service land up Laycock Creek.

May 20: Dispatched to Trafton Lane in John Day for a report of an unwanted person.

May 20: Responded to a livestock company on Highway 26 west of John Day for a report of an unwanted person.
